Contact an Attorney
The first step for anyone who has suffered an injury due to an auto accident or someone else’s negligence is to contact an experienced personal injury attorney. The lawyer will conduct a detailed intake, discuss your claim, advise you of your rights, and help you decide whether it is worth pursuing. Your lawyer can also find the necessary evidence to back up your claim.
Medical Treatment
The bulk of the pre-litigation case will be taken up by medical treatment. During this time, you will meet with a number of different doctors to get you the absolute best care and get the medical records that support our claim for damages. If you do not know where to turn, we work with some of the top doctors in the state and can provide you with information for a number of doctors to choose from to treat your injuries. Many of these doctors are nationally recognized as being at the top of their specialties. During this phase, we will closely monitor your treatment and be in touch with you regarding the game plan.
Compiling Records
As you are treating and particularly when you begin to wrap up treatment, our office will be requesting medical records and bills and organizing them in a clear easy to understand manner. Your attorney and case manager will review the bills and reports in detail to make sure nothing is missed.
Demand Preparation
The next step in the pre-litigation process is the demand stage. Here we will prepare a long demand to the insurance company laying out the scope of your injuries, your future outlook, the pain and suffering you have experienced, and the impact on your life the crash has had. The Demand Package is the most important part of the pre-litigation stage. Attorneys in our office worked for insurance companies for years and know how to tailor demands so that insurance companies have no choice but to pay full value on all claims.
Negotiations
After the demand goes out, an adjuster from the insurance company will typically reach out to us to negotiate the claim. This begins the negotiation process, which involves the attorney and the adjuster going back and forth over the value of the claim. Our attorneys are highly experienced at negotiation and know exactly how to extract every last dollar from the insurance company.
Settlement
Once we can get the insurance company up to a number we believe is fair, we will officially settle the case. This involves the insurance company providing us with a series of documents, some of which will need to be signed by you. Our team will work directly with you and the insurance company to coordinate this process and we will review all documents to ensure they are safe for you to sign.
Lien Negotiations
At any point, our team will look over all the various medical bills and records and contact all the providers to negotiate and resolve their liens on the case. This ensures the client has no personal liability after the case is resolved and that they are fully protected. Once the negotiations have been finalized we are able to distribute our client’s check and we handle payment of all medical bills.
